General terms and conditions of business

1. Scope

These General Terms and Conditions (GTC) apply to all deliveries from the La Kejoca online shop to consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity.

2. Contracting Party

The purchase contract is concluded with La Kejoca GbR, represented by: Keno Brandt, Carmen Brandt, Jonas Röllecke.

3. Conclusion of Contract

3.1 The presentation of products in the online shop does not constitute a legally binding offer but is merely an invitation to place an order.

3.2 By clicking the "Place Order (Paid)" button, you submit a binding order for the goods listed on the order page. The purchase contract is concluded when we accept your order by sending an order confirmation email immediately after receiving your order.

4. Right of Withdrawal

4.1 If you are a consumer (i.e., a natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of withdrawal in accordance with the statutory provisions.

4.2 If you, as a consumer, exercise your right of withdrawal under Section 4.1, you shall bear the regular costs of returning the goods.

4.3 Otherwise, the following revocation instructions apply:

Revocation Instructions

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us (La Kejoca GbR c/o Keno Brandt, Birkenstraße 104, 40233 Düsseldorf, Germany, info@la-kejoca.de) of your decision to withdraw from this contract by means of a clear declaration (e.g., a letter sent by post or an email). You may use the attached model withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse you for all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we receive your notification of withdrawal from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us (or to a person authorized by you to receive the goods) without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish the nature, characteristics, and functioning of the goods.

5. Prices and Shipping Costs

5.1 The prices listed on the product pages include the statutory value-added tax (VAT) and other price components.

5.2 In addition to the stated prices, we charge a flat rate of €3.00 (letter) or €7.00 (parcel) per order for deliveries within Germany. Shipping costs will be clearly communicated to you on the product pages, in the shopping cart system, and on the order page.

6. Delivery

6.1 Delivery is only available within Germany via Deutsche Post - DHL Group.

6.2 The delivery time may take up to two weeks.

7. Payment

7.1 Payment can be made by advance payment (bank transfer) or PayPal.

7.2 If you choose advance payment, we will provide our bank details in the order confirmation and ship the goods after receipt of payment.

8. Retention of Title

The goods remain our property until full payment is received.

9. Liability for Material Defects

9.1 The La Kejoca online shop is liable for material defects in accordance with the applicable legal provisions, in particular §§ 434 et seq. of the German Civil Code (Bürgerliches Gesetzbuch).

9.2 An additional guarantee for the goods delivered by the La Kejoca online shop only exists if it has been explicitly stated in the order confirmation for the respective item.

10. Dispute Resolution

We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.
